1. About these terms
These terms apply to the nomo app and this website (together, “nomo”), provided by AtrixTech Limited, Hong Kong (“we”, “us”). By using nomo you agree to them. If you don't agree, please don't use nomo. Apple's Licensed Application End User License Agreement also applies to apps downloaded from the App Store.
2. Not medical advice
nomo gives general nutrition and fitness information for healthy adults. It is not a medical device, and it doesn't diagnose, treat or prevent any condition. Its targets and insights are estimates, not prescriptions.
Talk to a doctor or registered dietitian before changing your diet or exercise if you are pregnant or breastfeeding, under 18, have or have had an eating disorder, or have any medical condition. Stop and seek help if something doesn't feel right.
3. Your account
You need to sign in with Apple to use nomo. You're responsible for activity on your account and for keeping your device secure. You must be at least [TBD: 16] years old to use nomo.
4. Your content and data
The food, recipes, photos and other content you add stay yours. You give us permission to store and process them to provide nomo to you, as described in our Privacy Policy. Please don't upload anything you don't have the right to share, or anything unlawful.
5. Estimates and accuracy
Nutrition values come from public food composition data and other sources, and AI food analysis is an estimate that you review before logging. Activity data comes from Apple Health and your devices. We work to keep everything accurate, but we can't guarantee that every value is correct or complete.
6. Acceptable use
Don't misuse nomo — for example by trying to access other people's data, interfering with the service, reverse engineering it except as the law allows, or using it to break the law.
7. Paid features
nomo may offer paid subscriptions in the future. If it does, prices, billing and cancellation will be shown before you buy, and purchases are handled by Apple under the App Store's terms. [TBD: add subscription terms, renewal and refund wording when paid plans launch.]
8. Changes and availability
We may update nomo, add or remove features, or change these terms. If a change to the terms is significant, we'll tell you in the app before it takes effect. We may suspend accounts that break these terms.
9. Ending your use
You can stop using nomo and delete your account at any time. Deleting your account deletes your data as described in the Privacy Policy.
10. Liability
nomo is provided “as is”. To the extent the law allows, we aren't liable for indirect or consequential losses, or for decisions you make based on nomo's estimates. Nothing in these terms limits liability that can't be limited by law, or your statutory rights as a consumer.
11. Governing law
These terms are governed by the laws of the Hong Kong Special Administrative Region, and disputes go to its courts, unless the law where you live gives you the right to bring them elsewhere. [TBD: confirm with counsel.]
